Terms of Service

You keep the rights to the photos, captions, and messages you post; you give us the limited license needed to display them in your private space and run the service. You agree not to misuse the service, all payments are final, and we may suspend accounts that harm others or the service. You are 18+. Disputes go to individual arbitration in India, not class actions.

• Eligibility — by using Cupidsgram you confirm you are 18 or older and you agree to these terms.
• Your space is private — only you and people you allow can open your space. You are responsible for keeping your password safe and for activity under your account.
• AI captions — captions our AI suggests are generated, stored, and displayed in your space; you may edit them, switch to manual or pool captions, or delete the post at any time.
• Payments & refunds — billing is handled by Whop under its terms. All payments are final and non-refundable; we do not offer refunds, partial or full, for any reason permitted by law. Where marketing copy says your space lasts “forever”, this means your access continues for as long as we operate Cupidsgram: one payment, no subscription, no renewals, no further charges.
• Third-party services — parts of the service rely on providers such as Whop (payments), OpenRouter and model providers (AI captions), and email deliverers. Those providers have their own terms and privacy practices, and we are not responsible for their acts, omissions, or outages beyond what law requires.
• Termination — we may suspend access for breach of these terms; you may delete your account and data at any time.

You retain ownership of your content. You grant us a limited, non-exclusive license to store, display, and process your content as needed to operate the service. AI-generated captions are content produced within your space and may be removed by you at any time. You confirm you have the permission of every person who appears in the photos and details you upload, and that uploading them does not violate anyone’s rights.

Some imagery in the service is AI-generated and may resemble real people. We are not affiliated with, endorsed by, or connected to any person depicted in it. If an AI-generated image or video concerns you, contact us and we will take it down promptly — see our DMCA & Takedown Policy for details.

• No impersonation of real public figures or harassment of third parties.
• No malware, scraping, or abuse of our APIs or infrastructure.
• No reverse-engineering the service, or using it to build a similar or competing product.
• No use for fake engagement, follower fraud, or deceptive marketing.
• No illegal content or activity — including where you live and in the US.

The Cupidsgram service — its software, design, branding, and content we create — belongs to us or our licensors. These terms give you no rights in it except the right to use the service as described here. If you send us feedback or suggestions, you agree we may use them freely without attribution or payment.

The service is provided “as is” and “as available”. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not promise the service will be uninterrupted, error-free, or secure. To the maximum extent permitted by law, neither party is liable for indirect, incidental, special, consequential, or punitive damages, and our total liability for any claim is limited to the amount you paid in the 3 months before the claim. Nothing in these terms removes consumer rights that cannot be waived.

You agree to defend, indemnify, and hold us harmless from claims, damages, and reasonable costs (including legal fees) arising from your content, your use of the service, or your violation of these terms or applicable law.

These terms are governed by the laws of India. Before starting any formal proceeding, contact us at the address below and give us 30 days to try to resolve the issue informally.

Except for claims that qualify for small-claims court and requests for urgent injunctive relief, you and we agree to resolve all disputes through binding individual arbitration, administered under the Arbitration and Conciliation Act, 1996, seated in Bengaluru, India, in English. You and we each waive the right to bring or participate in a class action or class-wide arbitration. Claims may be brought only in an individual capacity. You may opt out of this arbitration agreement by emailing us within 30 days of first accepting these terms.

We may update these terms from time to time. For material changes we will notify you by email or a prominent notice in the service. Continued use after notice means you accept the updated terms.
